Terms and Conditions, Event Disclaimer and Participant Consent

Please carefully read the following terms and conditions related to your participation in Dr Oberdan Marianetti’s programme (the “Programme”). By registering for the Programme, you (the “Participant”) signify your acceptance of and obligation to these terms and conditions (the “Agreement”). If you have any objections to the following Agreement, you should not register for or attend the Programme.


The website, the emails, the content of this page all form part of the relevant information for a visitor to make their mind up about participating in the Programme.





If a person is registering on behalf of a Participant/s it is the responsibility of that person to notify the Participant of the terms and conditions of registering, for which they will be agreeing to on the behalf of the Participant. Responsibility also includes providing full details of the Participant’s/s’ registration details as confirmed.



            Cancellations and Refunds


Dr Oberdan Marianetti will reimburse Participants who are unable to participate in the programme according to the following schedule:


  • 91 or more days from your scheduled workshop: 100% of all Participant fees

  • between 31 and 90 days from your scheduled workshop: 75% of all Participant fees

  • 30 days or less from your scheduled workshop: not refundable


Dr Oberdan Marianetti reserves the right to cancel or reschedule any program, workshop or event. In the event that Dr Oberdan Marianetti is forced to do so, Participant will receive a full refund or the opportunity to transfer their registration to the same course on another date. Dr Oberdan Marianetti is not responsible for any consequential loss or expenses, including travel and accommodation costs incurred by Participant as a result of cancellation. Dr Oberdan Marianetti will give a minimum of two weeks notice when cancelling an event whenever possible, however, Dr Oberdan Marianetti cannot be held liable when cancellation of an event with less than two weeks notice becomes necessary due to force majeure.



Force Majeure


Neither party shall be held liable or responsible to the other party nor be deemed to have defaulted under or breached this Agreement for failure or delay in fulfilling or performing any term of this Agreement to the extent, and for so long as, such failure or delay is caused by or results from causes beyond the reasonable control of the affected party including but not limited to fire, floods, embargoes, war, acts of war (whether war be declared or not), acts of terrorism, insurrections, riots, civil commotions, strikes, lockouts or other labour disturbances, acts of God or acts, omissions or delays in acting by any governmental authority or the other party.



            Personal Data


As used in this document, “personal data” means data, whether true or not, about a customer who can be identified:

(a) from that data; or

(b) from that data and other information to which we have or are likely to have access. 


Depending on the nature of your interaction with us, some examples of personal data, which we may collect from you, include your contact information, nationality, gender, date of birth, surveys, photographs and other audio-visual information.  


We may collect and use your personal data for any or all of the following purposes:

  • performing obligations in the course of or in connection with our provision of goods or services requested by you;

  • verifying your identity;

  • responding to, handling, and processing queries, requests, applications, complaints, and feedback from you;

  • managing your relationship with us;

  • processing payment or credit transactions;

  • sending you marketing information about our goods or services including notifying you of our marketing events, initiatives and promotions, lucky draws, membership and rewards schemes and other promotions;

  • measuring the progress of Participants through the Programme

  • complying with any applicable laws, regulations, codes of practice, guidelines, or rules, or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority;

  • any other purposes for which you have provided the information;

  • transmitting  to  any  unaffiliated  third  parties  including  our  third  party  service providers  and  agents,  and  relevant  governmental  and/or  regulatory  authorities, whether in Singapore or abroad, for the aforementioned purposes; and

  • any other incidental business purposes related to or in connection with the above.


We may disclose your personal data:

  • where such disclosure is required for performing obligations in the course of or in connection with our provision of the goods or services requested by you; or

  • to third party service providers, agents and other organisations we have engaged to perform any of the functions listed above for us.


In the event of your data being included in reports, charts or publications of any kind, all personal information will be kept confidential and the Participant’s identity will be kept anonymous, disguising any personal details that may be linked to your identity will do this.


The purposes listed in the above clauses may continue to apply even in situations where your relationship with us (for example, pursuant to a contract) has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period to enable us to enforce our rights under any contract with you).


The consent that you provide for the collection, use and disclosure of your personal data will remain valid until such time it is being withdrawn by you in writing.


You may withdraw consent and request us to stop using and/or disclosing your personal data for any or all of the purposes listed above by submitting your request in writing or via email to our contact details provided below.


Upon receipt of your written request to withdraw your consent, we may require reasonable time (depending on the complexity of the request and its impact on our relationship with you) for your request to be processed and for us to notify you of the consequences of us acceding to the same, including any legal consequences which may affect your rights and liabilities to us.


In general, we shall seek to process your request within ten (10) business days of receiving it.


Whilst we respect your decision to withdraw your consent, please note that depending on the nature and scope of your request, we may not be in a position to continue providing our goods or services to you and we shall, in such  circumstances, notify  you before  completing the processing of your request. Should you decide to cancel your withdrawal of consent, please inform us in writing in the manner described above.


Please note that withdrawing consent does not affect our right to continue to collect, use and disclose personal data where such collection, use and disclose without consent is permitted or required under applicable laws.


To safeguard your personal data from unauthorised access, collection, use, disclosure, copying, modification, disposal or similar risks, we have introduced appropriate administrative, physical and technical measures to secure all storage and transmission of personal data by us, and disclosing personal data both internally and to our authorised third party service providers and agents only on a need-to-know basis.


You should be aware, however, that no method of transmission over the Internet or method of electronic storage is completely secure. While security cannot be guaranteed, we strive to protect the security of your information and are constantly reviewing and enhancing our information security measures.





The Participant hereby understands that the tools, processes, strategies, materials, and information presented in the Programme are confidential, copyrighted, and proprietary to Dr Oberdan Marianetti and agrees not to record, duplicate, distribute, report on, teach or train from the Programme materials in any manner whatsoever without the express written permission of Dr Oberdan Marianetti.


Participants may not use any device to video, photograph, or record any aspect of the Programme. Participants who do not abide by this policy will be asked to destroy any recorded materials and may be asked to leave the Programme and will not be eligible for a refund.


Any unauthorized use or distribution of the proprietary concepts, materials, and intellectual property by the Participant or his/her representatives is prohibited and Dr Oberdan Marianetti will pursue legal action and full damages if these terms are violated in order to protect his rights.



Audio/Visual Release


By participating in the Programme, Participant understands that portions of the Programme’s live events may be recorded in video and audio and/or captured in still and/or digital photographs.


Participant agrees that Dr Oberdan Marianetti and his team have the right and permission to use such recordings and photographs should they include Participant’s, likeness, voice, testimonial, or photograph for marketing, advertising or any other purpose in any media or format, online and/or offline, now or hereafter without further compensation, permission, or notification to the Participant.


Participant understands and agrees that all recordings from Dr Oberdan Marianetti’s events are the exclusive rights of Dr Oberdan Marianetti and Participant does not ask for or expect compensation for the use of recordings or photographs in which Participant appears of speaks. Dr Oberdan Marianetti owns all rights to any audio, video, and/or photograph captured during the Programme.




Given the nature of the programme, which will include movement, breathwork and exposure to cold water, Dr Oberdan Marianetti is unable to accept Participants who are pregnant or who have experienced the following conditions:

  • Epilepsy

  • High blood pressure

  • Coronary heart disease

  • Kidney failure

  • A history of serious health issues like heart failure or stroke

  • Raynaud's syndrome

  • Shortly after an surgical operation

  • Cold urticaria

  • Severe asthma


When participating in any exercise or exercise programme, there is the possibility of injury. By accepting the terms in this Agreement and participating in the Programme, you confirm you are in good health, you are not pregnant, you do not suffer by any of the above conditions, you have fully understood the risks associated with your participating in the Programme, and, if necessary, you have consulted a physician to get written permission to attend the Programme.


During The Programme you agree to strictly follow the instructor’s instructions at all times.


The breathing exercises can have a profound effect and should be practiced exactly as prescribed. Make sure to always perform them in a safe environment, and without force.


Never attempt the exercises before or during driving, diving, swimming or taking a bath or in any environment where passing out could potentially cause injury. The simplest way to avoid risk is to sit on a couch or floor.


The cold is a powerful force and all exposure should be built gradually and slowly, and exactly as prescribed.


All activities in the workshop will be conducted in full safety under the supervision of your instructor.


You agree that you will immediately advise Dr Oberdan Marianetti or any of The Programme instructors if you observe any unsafe conditions with facilities or equipment.


You understand that some of The Programme activities may cause physiological responses you are not familiar with, but that they are normal and will be coached and managed by Dr Oberdan Marianetti or any of The Programme instructors.


You understand that the success of The Programme is heavily dependent upon each individual’s health, lifestyle, background, dedication, desire, and motivation, and that the results may vary, and will be based on many variables, including but not limited to, your individual capacity, life experience, unique health and genetic profile, starting point, expertise, and level of commitment. Therefore, Dr Oberdan Marianetti does not guarantee any specific results, and The Programme makes use of real past experiences, purely as educational tools and reference materials.





At the time of registration, Dr Oberdan Marianetti provided the most recent information available and the Participants accept that the content and/or the delivery of the Programme can change beyond the control of Dr Oberdan Marianetti.


Dr Oberdan Marianetti reserves the right to make changes as it deems necessary without penalty and in such situations no refunds, part refunds or alternative offers shall be made.


Dr Oberdan Marianetti reserves the right to update the Disclaimer and Terms and Conditions without notice to you.


Dr Oberdan Marianetti cannot control all content published or disseminated at the Programme. You may find other delegates’ or Participants’ communications, graphics, audio files or other information inappropriate, offensive, harmful, inaccurate, dishonest or misleading and/or deceptive, however you alone are solely responsible for your interaction with other delegates and agree to act responsibly and exercise caution, common sense and safety while in attendance at the Programme.


Dr Oberdan Marianetti, its directors, employees, agents and affiliates shall not be liable for any losses, damages, liabilities, claims or expenses whatsoever arising out of or referable to the event.





I acknowledge that this Programme is an extreme test of a person’s physical and mental limits and carries with it the potential for death, serious injury and property loss. The risks include, but are not limited to: actions of other people including, but not limited to, participants, volunteers, spectators, coaches, event officials, event monitors and/or producers of the event; lack of hydration, weather, and/or other natural conditions. I hereby assume all of the risks of participating in this Programme.


In consideration of my application and permitting me to participate in this Programme, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows: (A) Waive, release, and discharge from any and all liability for my death, disability personal injury, property damage, property theft or actions of any kind which may hereafter accrue to me or my traveling to and from this Programme, Dr Oberdan Marianetti, and their directors, officers, employees, volunteers, representatives and agents, the event sponsors and event volunteers, (B) indemnify and hold harmless all entities or persons mentioned in this paragraph from any and all liabilities or claims made by other individuals or entities as a result of my actions during this event.


This waiver shall be construed broadly to provide a release and waiver to the maximum extent permissible under the applicable law.
